Your agreement with Harvestpublicmedia.org

Please read these Terms of Use before using Harvestpublicmedia.org or any features of this site, including, but not limited to, Content Feeds, other syndicated distribution of content, Podcasts, widgets, and other social networking features. By using the Service, you agree to be bound by these Terms of Use and the Privacy Policy. If you do not agree to these Terms of Use and the Privacy Policy, please exit the Service and do not use the Service or any of its features. We reserve the right, at our discretion, to modify, add or delete portions of these terms at any time by posting updated Terms of Use and/or an updated Privacy Policy on the Harvestpublicmedia.org. Please check these Terms of Use and the Privacy Policy frequently for updates. Any modifications, additions or deletions to these Terms of Use or the Privacy Policy shall be effective immediately upon posting. Your continued use of the Service following the posting of updated Terms of Use or an updated Privacy Policy will mean that you agree to those changes.

Please note that these Terms of Use and the Privacy Policy are separate and distinct from the terms of use and privacy policy governing the websites of Harvest Public Media's partner stations.

Cost

Harvestpublicmedia.org does not charge for any service or content views. Most news articles will remain available in the pages of Harvestpublicmedia.org indefinitely.

Registration

Access to the content, services and features on Harvestpublicmedia.org does not require users to register and become members of Harvestpublicmedia.org.  However, Harvestpublicmedia.org requires those who would like to comment on content to become registered users. If you register with Harvestpublicmedia.org, you accept responsibility for all activities that occur under your account whether or not you expressly authorize such activities. You are responsible for maintaining the confidentiality of your password and for restricting access to your computer so others may not access Harvestpublicmedia.org using your username or account in whole or in part. Harvestpublicmedia.org may terminate membership and deny access to Harvestpublicmedia.org to any person for any reason in its sole discretion. Additionally and without limiting the generality of the preceding sentence, Harvestpublicmedia.org may terminate membership and deny access to Harvestpublicmedia.org to any person who, in Harvestpublicmedia.org’s sole discretion, violates this Terms of Service. Such termination or denial of access shall be in addition to any remedies available to Harvestpublicmedia.org in law and equity.

Your use of Harvestpublicmedia.org

Subject to the terms and conditions of this Terms of Service, Harvestpublicmedia.org grants you permission to access Harvestpublicmedia.org and view the Content solely for your personal, non-commercial use. In addition to viewing Content online, you may copy, download one copy on a single computer, and print a limited amount of content, for your personal, non-commercial use only, provided that (a) you include without modification all copyright and other proprietary notices contained in the content, (b) you do not modify the content, (c) you do not use the content in a manner that suggests Harvest Public Media promotes or endorses your, or any third party's, causes, ideas, websites, products or services, and (d) you do not use the content in any way that is unlawful or harmful to any other person or entity. In addition, you may use widgets and tools on Harvestpublicmedia.org that allow selected User Materials to appear on your personal, noncommercial web site, weblog or other application, subject to the conditions in the preceding sentence.

No quotes from any material on Harvestpublicmedia.org may be used in any media without attribution to Harvest Public Media.

These rules also apply to your use of Harvestpublicmedia.org:

  1. You will not in any way infringe or misappropriate any of the intellectual property in and to the Content accessible through Harvestpublicmedia.org. This means you agree not to copy, modify, publish, transmit, create derivative works from, transfer, sell or display the Content, including logos, trademarks or service marks, or otherwise violate the proprietary rights of Harvestpublicmedia.org or others except as expressly permitted herein.
  2. Harvestpublicmedia.org cannot grant permission to reuse or republish material from other information providers, such as the Associated Press or NPR. Please contact them directly.

Harvest Public Media encourages and permits links to content on Harvestpublicmedia.org. However, Harvest Public Media is committed to the highest journalistic ethics and standards and to independent, noncommercial journalism, both in fact and appearance. Therefore, the linking should not (a) suggest that Harvest Public Media promotes or endorses any third party's causes, ideas, web sites, products or services, or (b) use Harvest Public Media content for inappropriate commercial purposes or in any way that is unlawful or harmful to any other person or entity. We reserve the right to withdraw permission for any link.

Links to Third Party Sites
Harvestpublicmedia.org has provided links to Internet sites maintained by third parties, over which Harvest Public Media has no control. Harvest Public Media does not endorse the content, operators, products or services of such sites, and Harvest Public Media is not responsible or liable for the content, operators, availability, accuracy, quality, advertising, products, services or other materials on or available from such sites. Harvest Public Media shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, products or services available on or through such sites.

Use of Third Party Services
In some cases, Harvestpublicmedia.org provides features through tools provided by a third party over which Harvestpublicmedia.org has no control, influence, or oversight. You should only use these third party tools if you agree to be bound by their respective terms of use.

Content Feeds
Harvestpublicmedia.org provides Really Simple Syndication (RSS) Feeds at http://harvestpublicmedia.org/rss/articles/alland provides or may provide other content feeds on or through the Service, consisting of a selection of headlines, summaries or text blurbs, and links to full stories, which are delivered to users using Really Simple Syndication technology, other XML (extensible Markup Language) technology, or other syndication technology (individually, a "Content Feed" and collectively, the "Content Feeds"). The Content Feeds are available for personal, noncommercial use or for noncommercial use on the web site, weblog or similar application of a nonprofit corporation which is exempt from federal income taxes under Section 501(c)(3) of the Internal Revenue Code and which is not a news organization ("501(c)(3) Nonprofit Corporation"). You may display, excerpt from, and link to the Content Feeds on your personal web site, weblog, or similar application for personal, noncommercial purposes or on your 501(c)(3) Nonprofit Corporation web site, weblog, or similar application for noncommercial purposes, provided that (a) the links redirect the user to Harvestpublicmedia.org when the user clicks on them, (b) you do not insert any intermediate page, splash page or other content between the links and the applicable Harvestpublicmedia.org page, (c) the use or display does not suggest that Harvest Public Media promotes or endorses any third party causes, ideas, web sites, products or services, (d) the fundamental meaning of the content contained in the Content Feeds, including the headlines and summaries, is not changed or distorted, and (e) you do not modify the stories or other content that are linked to by the Content Feeds. If you display an entire Content Feed on your personal or 501(c)(3) Nonprofit Corporation web site, weblog or similar application, (a) you may not redistribute the Content Feed, and (b) you must provide attribution to Harvest Public Media or the relevant Content Feed provider adjacent to the Content Feed. Harvestpublicmedia.org reserves the right to discontinue providing Content Feeds and to require that you cease accessing or using the Content Feeds, or any content contained in the Content

Podcasts
Harvestpublicmedia.org provides podcasts (the "Podcasts") consisting of selected audio content from Harvest Public Media and other content providers. Podcasts are provided over the Internet using an XML feed and an associated audio file so that the audio file may be downloaded and played from a user's computer or transferred to a portable listening device. Podcasts are available for personal, noncommercial use only. You may download, copy and/or transfer to a portable listening device the Podcasts for your personal, non-commercial use only, provided that you do not modify the content. You also may link to Podcasts from your web site, weblog or similar application, as long as (a) the links redirect the user to Harvestpublicmedia.org when the user clicks on them, (b) you do not insert any intermediate page, splash page or other content between the links and Harvestpublicmedia.org, (c) the linking does not suggest that Harvest Public Media promotes or endorses any third party's causes, ideas, web sites, products or services, (d) you do not use Harvest Public Media content for inappropriate commercial purposes, and (e) you provide attribution to Harvest Public Media adjacent to the link. Harvest Public Media reserves the right to discontinue providing Podcasts and to require that you cease accessing or using the Podcasts, or any content contained in the Podcasts, at any time for any reason.

Member-submitted content

Members and other users of Harvestpublicmedia.org may be able, as dictated by the functionality of Harvestpublicmedia.org, to submit or to otherwise make available messages, e-mails, photographs, videos and other content for display on Harvestpublicmedia.org ("Member Content"). You are solely responsible for Member Content, and Harvestpublicmedia.org acts as a passive conduit for your online distribution and publication of Member Content. Member Content must conform to the guidelines below. Without limiting any of its rights in law and equity, Harvestpublicmedia.org reserves the right to remove any Member Content for any reason in its sole discretion including any Member Content that it believes may violate these Terms of Service, or any copyright or third-party rights.

By submitting or otherwise making available any Member Content to Harvestpublicmedia.org, you automatically grant Harvestpublicmedia.org a nonexclusive, royalty-free, worldwide, perpetual, irrevocable, sub-licensable (through multiple tiers), license to use, modify, copy, distribute, transmit, publicly display, publicly perform, publish, adapt, create derivative works of, distribute, transfer or sell any such content, for any purpose, including commercial purposes and in connection with advertising for the sole benefit of Harvestpublicmedia.org in any type of media or in any form now known or later developed, without any payment to you. In addition, you automatically waive and give up any claim that any use of such content violates any of your rights, including privacy rights, publicity rights, moral rights or any other right, including the right to approve the way Harvestpublicmedia.org uses such content. Digital Millennium Copyright Act ("DMCA")

Harvestpublicmedia.org respects the copyrights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), the text of which may be found on the U.S. Copyright Office site at http://www.copyright.gov/legislation/dmca.pdf, Harvestpublicmedia.org will respond expeditiously to notices of alleged copyright infringement that are duly reported to our Designated Copyright Agent identified in the notice below. We will disable and/or terminate the accounts of users who are repeat infringers.

If you believe that Harvestpublicmedia.org has infringed your copyright, please notify our Copyright Agent and provide the following information.

  1. An identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  2. An identification of the material on Harvestpublicmedia.org that you claim is infringing or is subject to infringing activity that is to be removed or access to which is to be disabled, with enough detail (including without limitation the URL of the material) to allow us to locate the material on our site.

Online conduct

Harvestpublicmedia.org encourages a free and open exchange of ideas in a climate of mutual respect. Any action by a user that infringes on another user's right to use and enjoy Harvestpublicmedia.org is prohibited. Harvestpublicmedia.org reserves the right, but does not assume any obligation, to monitor your online conduct to enforce these Terms of Use. Specifically, you may not:

  1. Provide any information that is false, misleading or inaccurate.

  5. Use any portion of Harvestpublicmedia.org for uploading, posting, e-mailing, transmitting or otherwise making available junk mail, commercial advertisements, or any other form of commercial solicitation.
  6. Attempt to interfere with any other person's use of Harvestpublicmedia.org.
  7. Misrepresent your identity or impersonate any person.
  8. Hold yourself out as sponsored by, endorsed by, or affiliated with Harvestpublicmedia.org.
  9. Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Harvestpublicmedia.org.
  10. Use or launch any automated means including spiders, robots, crawlers, scrapers and the like, to download or copy data or content from Harvestpublicmedia.org.
  11. Distribute any material that contains software viruses or any other computer code, files, or programs that are designed or intended to: (i) disrupt, damage, or limit the functioning of Harvestpublicmedia.org, any software, hardware, or telecommunications equipment used in connection therewith; or (ii) damage or obtain unauthorized access to any data or other information of any third party.
  12. Take any action that: (i) imposes or may impose, in Harvestpublicmedia.org 's sole discretion, an unreasonable or disproportionately large load on its infrastructure; (ii) interferes or attempts to interfere with the proper working of KansasCity.com; or (iii) disrupts or diminishes the quality of, interferes with the performance of, or impairs the functionality of KansasCity.com.

Termination
Notwithstanding any provision of this Terms of Service, Harvestpublicmedia.org reserves the right, without notice and in its sole discretion, to terminate any or all of the Harvestpublicmedia.org service and/or your license to use the Harvestpublicmedia.org service, or to block or prevent future access to and use of Harvestpublicmedia.org.
